Terms of Service — AWARE / EPAware Operated by EquityProtect Inc. (“EquityProtect,” “we,” “us,” or “our”) Effective date: June 1, 2026 These Terms of Service (“Terms”) govern your access to and use of EPAware and the AWARE platform (collectively, “EPAware”), including risk scores, reports, alerts, analytics, recommendations, visualizations, AI-generated content, educational materials, and related services offered in connection with the National Fraud Notification Network (“NFNN”). By creating an account, accessing EPAware, or using any related services, you agree to these Terms, our Privacy Policy, and any Mutual Non-Disclosure Agreement (MNDA) presented at registration. If you do not agree, do not use EPAware. EPAWARE TERMS OF SERVICE – KEY PROVISIONS 1. Educational and Informational Purposes Only EPAware, including all risk scores, reports, alerts, analytics, recommendations, visualizations, AI-generated content, and educational materials, is provided solely for informational and educational purposes. EPAware does not provide legal advice, title opinions, underwriting opinions, insurance coverage, financial advice, investment advice, appraisal services, surveying services, engineering services, or professional consulting services. Users should independently verify all information and consult qualified professionals before making decisions regarding real property, title matters, lending decisions, legal actions, or fraud prevention activities. 2. No Guarantee of Fraud Prevention EquityProtect does not guarantee the prevention, detection, interception, or mitigation of fraud, title theft, deed fraud, identity theft, forgery, unauthorized recordings, cybercrime, financial loss, or criminal conduct. No risk score, monitoring service, alert, report, or recommendation should be interpreted as a guarantee of future outcomes. A property identified as "Low Risk" may still become the subject of fraud or criminal activity. 3. Public Record Reliance EPAware utilizes information obtained from public records, third-party data providers, user-submitted information, automated systems, and machine-learning models. EquityProtect does not warrant the completeness, accuracy, timeliness, availability, or correctness of third-party data sources or public record information. 4. AI and Automated Decision Support EPAware may utilize artificial intelligence, machine learning, predictive analytics, and automated decision-support systems. Users acknowledge that such systems may produce incomplete, inaccurate, inconsistent, or incorrect results and should not be relied upon as the sole basis for decision-making. Human review remains the responsibility of the user. 5. County and Government Disclaimer Participation by a county, recorder's office, governmental agency, or public-sector partner does not constitute endorsement, recommendation, certification, guarantee, or approval of EPAware or EquityProtect. Government participation is limited to public education, awareness, and outreach activities. 6. Limitation of Liability To the maximum extent permitted by law, EquityProtect's total cumulative liability arising from or relating to EPAware shall not exceed the total fees paid by the user during the twelve (12) months preceding the claim. Under no circumstances shall EquityProtect be liable for indirect, consequential, incidental, special, punitive, exemplary, or lost-profit damages. 7. User Responsibility Users remain solely responsible for: • Property ownership verification • Title review • Fraud reporting • Legal compliance • Underwriting decisions • Lending decisions • Investment decisions • Claims investigation • Human review of alerts and reports 8. Mandatory Arbitration Any dispute arising from or relating to EPAware shall be resolved exclusively through binding arbitration administered by the American Arbitration Association. Users waive the right to trial by jury. 9. Class Action Waiver Users agree that all claims shall be brought solely in an individual capacity. Class actions, collective actions, mass arbitrations, representative actions, and private attorney general actions are expressly waived. 10. Intellectual Property All EPAware risk scores, algorithms, methodologies, analytics, software, reports, models, derivative works, and intellectual property remain the exclusive property of EquityProtect. Reverse engineering, benchmarking, scraping, or competitive analysis is prohibited without written consent. 11. Beta Features Beta, experimental, pilot, preview, AI, and early-access features are provided "AS IS" without warranties of any kind and may be modified or discontinued at any time. 12. Governing Law These Terms shall be governed by the laws of the State of Nevada without regard to conflict-of-law principles. ADDITIONAL TERMS 13. Eligibility and accounts. You represent that you have authority to bind your organization. You are responsible for safeguarding credentials and for activity under your account. 14. Acceptable use. You will not misuse EPAware (including attempting unauthorized access, scraping in violation of these Terms, or uploading unlawful content). We may suspend or terminate access for violations. 15. Indemnity. You will defend and indemnify EquityProtect against claims arising from your misuse of EPAware or violation of these Terms. 16. Changes. We may modify these Terms; material changes will be communicated as described in our policies. Continued use after changes constitutes acceptance of the updated Terms. 17. Contact.
